CHEQUE GUARD — TERMS OF USE (EULA)

AGREEMENT
These Terms of Use ("Terms" or "EULA") are a legal agreement between you (the "End-User") and alzafir.com for the Cheque Guard mobile application (the "Licensed Application") and related website services (together, the "Service"). By downloading, accessing, or using the Licensed Application, you agree to these Terms. If you do not agree, do not use the Service.

1. ACKNOWLEDGEMENT
You and we acknowledge that this EULA is concluded between you and alzafir.com only, and not with Apple Inc. ("Apple"). alzafir.com, not Apple, is solely responsible for the Licensed Application and the content thereof.

These Terms do not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions as of the effective date of this EULA (which we acknowledge we have had the opportunity to review).

2. SCOPE OF LICENSE
We grant you a limited, non-exclusive, non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the Licensed Application except as allowed by applicable law or the Usage Rules.

3. MAINTENANCE AND SUPPORT
alzafir.com is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law.

You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. WARRANTY
alzafir.com is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be alzafir.com's sole responsibility.

Except as required by law, the Licensed Application is provided "as is" and "as available" without warranties of any kind, including fitness for a particular purpose and non-infringement. We do not warrant that cheque scanning will always extract fields correctly, that reminders will always be delivered, or that the Service will be uninterrupted or error-free. Always verify cheque details and banking obligations yourself.

5. PRODUCT CLAIMS
You and we acknowledge that alzafir.com, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with any use of HealthKit or HomeKit frameworks (Cheque Guard does not currently use HealthKit or HomeKit).

Nothing in these Terms limits our liability to you beyond what is permitted by applicable law.

6. INTELLECTUAL PROPERTY RIGHTS
You and we acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, alzafir.com, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. LEGAL COMPLIANCE
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. THIRD PARTY TERMS OF AGREEMENT
You must comply with applicable third-party terms of agreement when using the Licensed Application, including Apple's terms, your wireless data service agreement, and any terms of third-party services used through the app (for example OpenAI's API terms when you choose to scan a cheque photo).

10. THIRD PARTY BENEFICIARY
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

THE SERVICE
Cheque Guard helps you record post-dated cheques, extract details from cheque photos you choose to scan, organize records on your device, and receive local reminders before due dates.

The Service is a personal productivity tool. It does not process payments, move funds, connect to bank accounts, or act as a bank, payment institution, or legal advisor.

SUBSCRIPTIONS AND PAYMENTS
Cheque Guard Plus is an auto-renewable subscription sold through Apple In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase, or at the end of any free trial if you do not cancel at least 24 hours before the trial ends.

Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel subscriptions in your Apple ID Account Settings after purchase.

Any unused portion of a free trial is forfeited when you purchase a subscription where applicable. Prices are shown in the App Store listing and in the app at the time of purchase and may vary by storefront.

Refunds for App Store purchases and subscriptions are handled by Apple under Apple's refund policies. We do not receive or store your payment card details.

YOUR CONTENT AND RESPONSIBILITIES
Cheque records and photos you add remain under your control on your device (and, if you enable it, in your own iCloud account). You are responsible for the accuracy of information you enter and for ensuring you have the right to photograph and process any cheque images you submit for scanning.

You agree not to misuse the Service, attempt unauthorized access to our systems, or use the Service for unlawful purposes.

PRIVACY
How we handle personal data is described in our Privacy Policy at https://alzafir.com/privacy. By using the Service, you also acknowledge that policy.

LIMITATION OF LIABILITY
To the fullest extent permitted by law, alzafir.com and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for Cheque Guard Plus in the twelve months before the claim or (b) USD 50, except where liability cannot be limited under applicable law.

TERMINATION
You may stop using the Service at any time by deleting the app and cancelling any active subscription with Apple. We may suspend or stop providing the Service if required by law or if you materially breach these Terms.

CHANGES
We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. Continued use of the Service after changes means you accept the updated Terms. Material changes may also be noted in the app.

GOVERNING LAW
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Courts of the UAE have exclusive jurisdiction, except where consumer protection rules in your place of residence require otherwise.
